IMPORTANT: By downloading, installing, or using Smart Chinese, you agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree, do not use the application.
DoiTech International ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to use Smart Chinese ("the App") on devices you own or control, subject to the terms of this EULA and any applicable platform terms (such as the Apple Media Services Terms and Conditions or Google Play Terms of Service).
This license does not allow you to:
The App offers optional auto-renewable subscriptions to unlock premium features. The following information applies to all subscription purchases:
Available Subscription Plans:
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing or Cancelling Subscriptions:
Free Trial: Where a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.
Refunds are subject to the policies of the platform provider (Apple App Store or Google Play). DoiTech International does not process refunds directly.
If you create an account in the App, you are responsible for maintaining the security of your account and all activities that occur under it. You must immediately notify us of any unauthorised use or security breach. We will not be liable for any damages resulting from unauthorised use of your account.
You agree not to use the App or its content:
The App, including all code, graphics, content, curriculum data, audio, and documentation, is the intellectual property of DoiTech International and is protected by copyright and other intellectual property laws. This EULA does not grant you any rights to trademarks, trade names, or service marks of the Licensor.
Your use of the App is also governed by our Privacy Policy. Learning progress and preferences are stored locally on your device or in your account. We do not sell your personal data to third parties.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Licensor does not warrant that the App will be uninterrupted, error-free, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOITECH INTERNATIONAL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
The aggregate liability of DoiTech International relating to the services will be limited to the greater of one dollar (AUD $1.00) or any amounts actually paid by you to DoiTech International in the one month prior to the event giving rise to such liability.
This EULA is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies. Termination of this EULA does not entitle you to a refund of any subscription fees paid.
This EULA shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict-of-law provisions. Any disputes arising from this EULA shall be resolved in the courts of New South Wales, Australia.
The Licensor reserves the right to modify this EULA at any time. Updated terms will be posted at this URL and reflected in subsequent app updates. Continued use of the App after changes constitutes acceptance of the revised terms.
